Abstract
A new era of regulation at the European level began on September 21, 1990, when the Council Regulation No. 4064/89 came into force. This deals with the control of concentrations between undertakings, which in the majority of cases means mergers and takeovers. This article shows that events which have occurred since the regulation came into force have exposed problems in achieving the coherence, fairness and speed of decisions from a single source commended by Sir Leon Brittan, vice president of the European Commission, and have caused some difficulty with mergers policy used in Great Britain. This is done by examining the case of the takeover of the Midland Bank, which involved both policy regimes.
