Abstract
The financial crisis and the collapse of commercial banks are among the concerns of states and regulators, as governments and central banks worldwide seek to maintain financial and banking stability. As countries seek to keep pace with banking and financial development, they establish laws and regulations to help the regulator deal with financial and banking crisis. Central banks should have the ability and independence to perform their operations without any interference from the government, ministry of finance or any other higher body. Central bank structure should be clear, as should its objectives and tasks, to give the administration, governor and board of directors the rights to perform their work. Crisis management, bank resolution and deposit insurance are the keys to managing any bank failure or crisis. Kuwaiti laws, such as Commercial Law No. 68 of 1980, Company Law No. 1 of 2016 and Central Bank of Kuwait Law No. 32 of 1986, do not mention any of these systems, hence there is a gap in Kuwaiti regulation in these areas. Neighbouring states such as the United Arab Emirates and the Kingdom of Saudi Arabia adopted such systems in 2018, and kept their regulations developed according to international standards; these states are similar to Kuwait in terms of geography, culture and language, and are also in the Gulf Cooperation Council. International institutions such as the Basel Committee, the International Association of Deposit Insurers, the International Monetary Fund and the World Bank have worked hard to develop the banking regulatory system. They tried to improve banking crisis management and bank resolution and deposit insurance systems, and help states to establish such systems by issuing reports and standards that states could use to enhance banking regulation.
