Abstract
The World Bank and the International Monetary Fund (IMF) have enjoyed significant immunity from conventional norms of accountability and culpability in spite of their emergence as key financial institutions in the global economy in the postwar period. This historical impunity sits uncomfortably with the wide-ranging social, economic and political impacts of their complex mandates and is inconsistent with the development of the aforementioned norms in other areas of public and private international law.
This paper reviews the current mechanisms and strategies employed to establish institutional accountability for human rights violations and argues that the contemporary focus on internal as opposed to external instruments of accountability and culpability is inadequate given the inherent deficiencies within the organisational governance structures of the institutions concerned and the normative limitations of the international human rights regime. Consequently, recourse to authoritative frameworks outside the Bank and Fund and attention to strategies in other areas of law are necessary to establish more comprehensive mechanisms to ensure that the operations of these institutions do not contravene fundamental principles of human rights.
