Abstract
Criticises the Banking Act 2009 (Restriction of Special Bail-in Provision, etc.) Order 2014 and compares it unfavourably with Directive 2014/59 (Bank Resolution and Recovery Directive), focusing on the protection of netting in derivative contracts which qualify for bail-in.
