Abstract
Since 2003 there have been multiple legal processes focused on allegations of unlawful killing and ill-treatment of Iraqi civilians committed by UK armed forces. They have provoked political reaction, providing a focus for establishing constraints on legal actions for human rights abuses being brought against British forces in service overseas. This article interprets this history within the context of the efficacy and limits of law and judicial review as means for assessing the exercise of power, attributing responsibility for the unlawful acts of state agents, and holding the state and its officials accountable for systemic violations of human rights. It does so by outlining four discernible phases of legal response before considering their possible wider implications for UK law when faced by allegations of widespread human rights abuses.
